Terms of Service

Effective: January 4th, 2026 · Clinic contact: [email protected] · These Terms govern access to and use of the online booking portal operated for the medical practice of Dr Hasan (the “Clinic,” “we,” “us,” or “our”). By creating an account, requesting an appointment, or using any feature of this site, you (the “patient,” “you,” or “user”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not create an account or use the portal.

1. Nature of the Service & No Emergency Care

The portal provides a convenient way for existing and approved patients of Dr Hasan to request, view, and manage appointments during and outside typical business hours. It does not provide triage, emergency assessment, or clinical instructions. The portal is not a substitute for in-person assessment or emergency services. In an emergency, call 911 or go to the nearest emergency department immediately. Clinical advice is provided only by licensed professionals in the course of care, not by this website.

2. Eligibility, Accounts, and Accuracy of Information

The portal is intended solely for individuals who are (a) legally able to consent to these Terms, and (b) current or accepted patients of Dr Hasan. You agree to provide accurate and complete information (including legal name, date of birth, contact information, and a Health Care Number) and to keep it current. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Misuse, impersonation, or providing false or misleading information may result in suspension or termination of access and, where appropriate, notification to regulators or law enforcement. New patients should not use this portal to seek initial care unless explicitly invited to do so by the Clinic.

3. Appointment Requests and Confirmations

Submitting a booking request through the portal does not, by itself, entitle you to or guarantee an appointment. Requests are subject to clinical appropriateness, availability, and verification. Appointment times are targets that may shift due to clinical realities, urgent patient needs, or technical issues. In rare circumstances, an appointment may be missed or require rescheduling on short notice.

If an appointment appears delayed, you agree that it is your responsibility to monitor the portal and, if the start time has passed by at least 60 minutes without commencement, to politely notify staff at your next opportunity so that we may re-queue or reschedule you as appropriate. Calls to staff about lateness before sixty (60) minutes have elapsed from the booked time are considered premature and, to protect clinical workflow, may be treated as spam and may result in the appointment being revoked or rescheduled at our discretion.

It is your responsibility to avoid booking on statutory holidays. The portal may technically allow you to select such days, but the Clinic does not guarantee availability or service on statutory holidays. Any booking made for a statutory holiday may be declined, rescheduled, or cancelled at the Clinic’s discretion without prior notice. All dates and times on the portal are interpreted in the Clinic’s local time zone.

4. Conduct, Respect, and Safety

We are committed to a safe, respectful environment for patients and staff. Any violent, threatening, abusive, harassing, hateful, defamatory, or otherwise disruptive conduct—verbal, written, or physical—whether in person, over the phone, by message, or during a virtual visit—is grounds for immediate termination of the family doctor–patient relationship and removal from care, subject to professional and legal obligations regarding continuity and emergency coverage.

Boasting, disparagement, or public or private slander directed at Dr Hasan, the Clinic, or other patients that undermines trust or safety may lead to immediate discharge if staff deem it appropriate. Users are expected to be courteous, patient, and collaborative; kindness and clarity help everyone receive timely care.

5. Clinician Discretion to End an Encounter

For personal safety and professional well-being, Dr Hasan (or a delegate clinician) may, at their sole discretion, pause, leave, or end a session—whether in person, by phone, or by video—if continuing the encounter appears unsafe, abusive, or likely to harm the clinician’s well-being or professional judgment. Where appropriate and feasible, we will attempt to reschedule or provide alternative follow-up consistent with professional obligations.

6. Phone Use, Tickets, and Contact Rules

This portal exists so patients can book independently during and outside business hours. The portal does not grant open permission to phone the Clinic during or outside business hours regarding routine booking matters. Unnecessary or repeated calls may disrupt clinical care.

The Clinic operates a two-ticket system for non-emergency misuse: repeated disregard of these rules (e.g., calling within 60 minutes of a pending appointment to “chase” the start time; demanding immediate service; abusive tone) may result in a ticket on your account. After two tickets, appointments may be cancelled and portal access suspended, without prejudice to discharge from the practice.

7. Data Theft, Security Events, and Fraud

Any account associated with data theft, credential sharing, scraping, intrusion attempts, or other unlawful or unauthorized access will be terminated immediately. Relevant logs may be preserved and provided to the appropriate authorities or regulators in accordance with our Privacy Policy and applicable law.

8. Telemedicine and Technical Requirements

Virtual care has limitations, including variable audio/video quality, incomplete physical examination, and reliance on the accuracy of information you provide. You are responsible for having a private space, reliable connectivity, and a working device. If a virtual visit is not clinically appropriate, you may be directed to in-person care or emergency services. Technical issues may result in delay, rescheduling, or conversion to a telephone visit at our discretion.

9. Cancellations, No-Shows, and Late Arrivals

To respect everyone’s time, appointments must be cancelled or rescheduled through the portal at least 48 hours in advance. Cancellations made within 48 hours of the scheduled appointment time may incur a cancellation fee of up to $100 CAD. Late arrivals may shorten or forfeit the visit. Repeated no-shows or late cancellations may result in restrictions on future bookings or discharge, in accordance with professional obligations.

10. Communications and Notifications

By using the portal, you consent to receive transactional communications related to booking and care (e.g., confirmations, reminders, notifications of delays or rescheduling) by email, SMS, or phone using the contact details you provide. Message and data rates may apply. You are responsible for keeping your contact information current and for monitoring your messages and portal notifications.

Clinic staff will never contact you to promote or sell goods, products, or unrelated services. Any telephone call, text message, or in-person approach suggesting otherwise should be treated as suspicious and reported to us immediately. The only authoritative source of medical guidance or instructions is direct communication from Dr Hasan or an authorized clinical delegate. Do not rely on or act upon unsolicited offers or requests purporting to come from Clinic staff.

11. Acceptable Use and Intellectual Property

You may not copy, reverse engineer, interfere with, or attempt to gain unauthorized access to any part of the portal. The portal and its content are owned by the Clinic or its licensors and are provided on a limited, revocable, non-transferable basis solely for booking-related purposes as an approved patient.

12. Disclaimers and Limitation of Liability

The portal is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We are not liable for delays, missed appointments, data loss, or damages arising from network failures, device issues, browser incompatibility, user error, or events outside our reasonable control. To the extent permitted by law, our total liability for any claim related to the portal will not exceed one hundred Canadian dollars (CAD $100). These limits do not restrict liability that cannot be limited by law.

13. Indemnity

You agree to indemnify and hold harmless the Clinic and its personnel from claims, damages, liabilities, costs, and fees arising from your misuse of the portal, breach of these Terms, or violation of law, except to the extent caused by our negligence or willful misconduct.

14. Termination

We may suspend or terminate your account or access to the portal at any time for any reason, including safety concerns, abuse, suspected fraud, or inactivity. Termination of portal access may be accompanied by discharge from the practice where appropriate and lawful. Continuity or emergency coverage will be handled consistent with professional obligations.

15. Professional Standards and CPSBC

All use of this portal and any resulting clinical interactions are governed by the professional obligations of Dr Hasan under the College of Physicians and Surgeons of British Columbia (CPSBC). These standards include patient confidentiality, respectful conduct, appropriate use of telemedicine, and lawful record-keeping. Where portal rules intersect with clinical judgment, CPSBC standards and clinical judgment prevail.

16. Governing Law and Venue

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the courts located in Burnaby, British Columbia for all disputes not subject to a different dispute process required by healthcare regulators.

17. Changes

We may update these Terms from time to time. Material changes will be posted here with a new “Effective” date. Your continued use of the portal after changes are posted constitutes acceptance of the revised Terms.
